Where to check what a plot is designated for
Start by asking whether the plot is covered by a local plan. Everyone has the right to inspect the general plan and the local plan and to obtain an extract and a map excerpt from them. You apply at the municipal office.
Plan boundaries can be previewed on geoportal.gov.pl or on the municipality’s map service, and the resolutions can be found in its Public Information Bulletin (BIP). Before signing, however, rely on a document issued by the municipality.
A plot covered by a local plan
A local plan is a resolution of the municipal council with a text and a drawing. A symbol on the drawing shows the land use, and its meaning is explained in the text of that resolution. Symbols can differ between municipalities.
In the plan’s provisions, read:
- the land use and permitted functions,
- building lines, which show where a building may stand,
- building parameters, such as height, roof shape and built-up area,
- rules for access and utility connections.
If a plan covers the plot, a zoning decision is not needed. Plans adopted before the reform remain in force until the municipality adopts new ones for that area.
A plot without a plan: the zoning decision
Where there is no plan, the way the land may be built on is set by a decision on development conditions, commonly called WZ. The municipality may issue it only if all the statutory conditions are met. The most important are:
- at least one neighbouring plot, accessible from the same public road, is built on in a way that allows requirements for new buildings to be set,
- the land has access to a public road,
- existing or planned utilities are sufficient for the planned construction,
- the land does not require consent to change agricultural or forest land to non-agricultural and non-forest use,
- for a new building, the land lies within an infill development area designated in the general plan.
The act provides several exceptions to these rules. The decision does not give any right to the land.
Who can apply? An application filed by 31 December 2026 may also be submitted by someone who is not the owner, for example a buyer before the purchase. From 1 January 2027, the municipality will issue the decision only to an applicant with the right to use the property for construction purposes. That right belongs, for example, to the owner or to a person whose agreement with the owner allows construction work. The applicant makes a declaration to that effect.
What has changed since September 2026
The 2023 planning reform introduced the municipal general plan. It is a local law covering the whole municipality. It divides the area into planning zones and may designate infill development areas.
The former study of spatial development conditions remained in force no later than 31 August 2026. Since 1 September 2026, a zoning decision on a new application can only be issued in a municipality where a general plan is in force.
For a new building, the plot must also lie within an infill development area. If the municipality has not designated such an area, a new decision for a new building cannot be obtained. This requirement does not apply, among others, to rebuilding, extensions and adding storeys.
For a plot without a local plan, ask the municipality two things: whether a general plan is already in force and whether the plot lies within an infill development area.
A plot with a zoning decision already issued
Plot listings often mention that a zoning decision has been issued. Before buying, look at the decision itself, not just the mention in the listing. Check:
- what development it allows and with what parameters,
- whether it is final and since when,
- whether it has an expiry date: a decision expires 5 years after it becomes final, but this period does not apply to decisions that became final before 1 January 2026 or were issued in proceedings started before 16 October 2025,
- who it was issued to: the municipality will transfer the decision to the buyer with the consent of the person it was issued to, if the buyer accepts all its conditions.
A zoning decision does not replace a building permit or a notification of construction. It is the basis for preparing the design.
Next step: a building permit or a notification
When issuing a building permit, the authority checks that the site development design complies with the local plan or the zoning decision. The general plan itself is not the basis for this check.
The procedure depends on the building. Before buying, also confirm road access and the possibility of connecting utilities.
Questions for the municipality before you sign
Before signing, get answers to four questions:
- Is the plot covered by a local plan? If so, ask for an extract and a map excerpt.
- If there is no plan: does the municipality have a general plan in force, and does the plot lie within an infill development area?
- Has a zoning decision been issued for the plot, to whom, and when did it become final?
- Has the municipality started preparing or amending a local plan for this area?
How I can help
If you are interested in a plot from my listings, I will pass on the information and documents I have received from the seller. I will also suggest what to ask the municipality before you sign. Binding information on land use comes from the municipal office, and this guide is not legal advice.
